Hello,
I have a h1b visa that will expire in March 2010. This visa has been already renewed for its second time so, as you know, I wont be able to renew it once again.
Currently I am applying for permanent residency ( EB3 category) and I am in the AOS phase. I have the possibility of renewing EAD's every year, but I need to understand what is going to happen when the H1b expires. Can I renew EAD's even after the visa is no longer valid? How does it work?

I have exact opposite case. My 140 was approved at TSC. Lawyers sent 485 to NSC. I asked they said its ok. Since they sent copy of 140 with 485. You can file anywhere.

I see that India got around 27400 Gcs. Does it mean spill over was happening during FY 2007? I was under the impression it started since FY 2008.

Hi All,
I applied for my I485 during the July 07 fiasco and also for EAD/AP for me and my wife. I just renewed my H1B for another 3 years and my manager just said that since I have my H1B, I shouldnt renew my EAD/AP when it expires next year since it is quite an expense for the company. My wife is using her EAD for her current job and so that will still be renewed.
Just wanted to find out if there can be any issues if I dont renew just my EAD/AP?
Also after filing for the I485 in July 07, we did our Fingerprinting in Feb 08. We had not received FP notice and had to go through infopass to get FP done. Since then we've not received a renewal for FP again. I believe FP expires in 18 months and we need get it done again. Should I be receiving FP notice for renewal or do I need to go thru infopass again?

I am student on OPT extn working for an Non Profit Organisation ( non everified) , Since 2 months, I Know i should not work for non everfied company on OPT Extension, So i asked my company to do H1 asap, since workiing for non everified aslso considered as unemployed, But i am aware that in entire OPT we can unemployed for total 120 days.
My company is an Non Profit Organisation & dont have relatioship with any educational institues or research org.
Is my company eligible for H1 cap exempt, so that i can keep my start date as approval of H1? so i wont fall out of status since my H1 starts as the days of approval............or I need to wait until oct 1, 2010,
Even if i start at oct 1,2010, Will it affect my green card processing, since I worked for non everified around 6 months...........
Please provide your inputs.......

One of my friends was in the same boat as yours and he said YES. No problem in visa issuance. And as per my friend, the officer already knew that he was attending school. I think the schools report all enrollment to USCIS.
Also my wife went for visa interview recently. She is on H4 and she also said yes to Q33.

My 140 was filed for a future Team lead position. I am currently a Sr Sw Engg with the same employer. The job description is nearly the same. But I am not sure how this little quirk effects my AC21 eligibility. When does my 180 day start counting ? From filing date or from the date I get the Team lead title ?

While renewing, on the form, there are 2 questions:
14 Current Immigration Status
15 Manner of Last Entry
(both seem to have the same answer)
Any idea .. what I need to fill here?

My labor/I-140 documents show my salary to be 85K, I am yet to receive my I-140 approval from Nebraska Processing Center, filed in June 2006 under EB-2. Would it cause any problems when I file my I-485 ( priority date March 2004 ) next year if the salary for 2006 is less than 85K ? I was unemployed for two months this year unexpectedly. Thank you for your responses.
