I am currently in L1B status and filed for AOS (I-140/I-485) in July 2007. My I-140 was approved last week and 180 days of pending I-485 are also over. My question is whether there is a huge risk involved in porting to a new employer using EAD, particularly because I do not have any other safety net like H1-B status. I understand, in case of I-485 denial, I will not have any other option to fall back upon. But if USCIS mistakenly issues a NOID or denial for some strange reason, would I have any other option to appeal without going out of country. Can I continue appealing such a potential denial from outside of USA and come if they reopen the case.
More specifically, I have heard some of the AC21 cases have been mistakenly denied or a NOID issues due to ignorant USCIS immigration officer. Can something be done to revive the AOS when there is no backup option like H1B? Would that action needs to be continued from outside of USA or can be done here itself.

I had the same case. Call up the 800 number in the reciept and find options where you can change the address on the phone. The reason I tried this was because as the # is not in the system you can't even report a problem with the case.
Now when the representative is available, tell them the issue and they will connect you to someone who can verify the status for you. The next layer rep will ask your name and address for verification and tell you the status.

I just received my initial EAD and it is only valid for 1 year. My priority date is October 2006. Shouldn�t I have received an EAD valid for 2 years?

is your case eb2 or eb3? what nationality are you from? if you are eb2 india, then it could potentially mean that you might get GC within one year...

If your old visa has not beenexpired at the time of re-entering . You will need to carry your new approved I-797. But your I-94 would have the expiration date as that of the expiration date as on your old Visa.
I had the same situation last year and the processing went smoothly at port of entry, but you may check for any chages in the regulations.

Hi,
I am in 7th year of H1B which expires in Dec 2011. I-140 is approved. Applied for H1B extension in Oct2010 (after 6 yrs completed) based on approved I-140 but got extension for only 1 yr till 2011 (got client letter for 1 yr only) . Can i transfer my H1B to new Employer based on my approved I-140 from my current Employer? If so, can i get 3 yr extension with the new Employer or will the new H1B be valid only till 2011?

Hi,
I am currently on 8th year of H1-B, employer to file for 9th year H1 extension next week. Labor filed in Dec 07, denied in Jan 10, appealed immediately. Currently awaiting response to the labor appeal. H1 expires in Jan 2011.
I work for a consulting firm and my client has been requesting me to join full time as an employee, willing to transfer H1 immediately. My question to the experts is
If I change employer, will I have to start everything from scratch or can i continue the GC from where my current employer left?
And given the current political situation (due to the economy), should I stick to current employer until H1 extension goes through and then make a move (if any possibilities exist)?
Any advise is much appreciated.

I spend 30mintes reading the Title V-Immigration benefit to get sense of this new immigration law.

I applied for EAD and since last 4 months no action has been taken by TSC on my application. After 90 days, the local office gave me an interim EAD for 3 months. I have also initiated a status enquiry by the customer service at USCIS but haven't rec'd any updates till now. My question here is
1. What other options do I have, since from Oct 1, 06 local office won't issue interim EAD's as a policy change by USCIS.
2. Can I apply concurrently for second application. It seems my first application is lost.
Has anyone earlier been in same boat and has taken any other steps.
Thanks in advance.
