Hi,
I am on EB2+PERM. I got LC approved and currently filed for I-140 and 485.
As I understand unless the I-485 is pending for more than 180 days after the approval of I-140, I have to restart the whole process again with the new employer (expect that I can port PD if I want to).
Now are there any chance that if the above scenario happens, and my employer did not revoke I-140 or 485, that I can still receive my GC? Or that will be illegal? Please clarify.

And I have to renew my AP, where should I send my AP renewal docs, NSC or NBC?

Hi
We (my wife and I) applied for our EAD renewals. I got email 2 days back saying 'Card production ordered', but did not get a similar mail for my wife.
Is it normal to have applicant and dependent's timings for approvals on different dates? I was thikinkg that since we applied on the same date, and since my case is renewed, my wife's should also be renewed at the same time. Can I wait more or is this something a cause of concern?
Any suggestions please

Can anyone throw some light on this query...
I presently work for a cap excempt employer and now looking for employer who could file for my h1b under cap subjected in the month of april witha start date of oct 2008.
I would like the new employer to file my visa in such a way that, i could still continue with my present full time job even after oct 2008. Based on what i have understood, i guess if the new employer files as "COncurrent H1b" then i can join him at my wish after oct 2008 provided new emplyer has not revoked my h1b. Am i right..???
Also ..how many concurrent h1b can i have at a time..???
I don't want to miss this year quota, so want to make sure i take all precaution to get h1b cleared.
Greatly apprecite inputs...

Hello gurus,
My H1 expires in march 2009, I have valid EAD and AP, I want to renew my H1to be on the safer side.
My wife made use of her EAD for few months and now she is not working, and we are planning to visit India for few weeks next year and get H1 and H4 stamped.
here are my questions:
1. Can my wife get her H4 extension when I apply for my H1 extension ?
2. Does USCIS know that she used her EAD (Is there a way that they can find out) and will there be any problem in approving H4 extension ?
3. Now that she is not using her EAD, Is she back on H4 status ? She came here as H4 and never made a trip back.

If you call USCIS 1800 number, and you ask the representative to raise a service request then they email the service center asking for details. Most of the time, personnel from service center will call back with the information that you have requested. If you learn there is a way you can email the service center, please post here.

Giving I-485 benefits to people without current PDs is a bad idea.
so what 's good idea to you......putting all of EB applicants who are waiting to file 485 in waiting state until you get your GC is a good idea?
First of all, why are you being worried about this action item being EB1 applicant and you will get your GC in no time...
I don't think you are from EB1 category...You are selfish mind who holds EAD and doesn't want other EB applicants to come in to 485 waiting line.
would you have had the same thought if there was no July 07 fiasco and if you would need to wait in the line........selfish minds like you can't stop this action item.

I am married to a US Citizen and we filed my I-130 petition, which was approved in April 2007. However, the I-797 also notice said that I was not eligible to adjust status from within the US based on evidence presented in the I-130 and that we should consult a local USCIS office to determine what this evidence was. When we consulted an officer at the local USCIS field office, we were advised to proceed with the filing as the language about ineligibility to adjust status in the US was 'standard'.
We have since filed my I485, application for EAD, and AP. Unfortunately I didn't know about priority dates and their impact on our filing. if my priority is not current does this mean that the 485 will be rejected?

My friend Cyrus Mehta reports on a disturbing incident that occurred last week at Newark's international airport. Apparently CBP officers got hold of the new Neufeld memorandum on H-1B workers at third party work sites and decided to start applying it on their own. This week because of recess all the senators will be in your home town. From March 27 things will move very fast. This is the last chance we all have to meet the senators since they are in their hometown. So no matter which bill comes to the floor, in the last week of March or the first week of April it is very important that we do following things:
1. During congressional recess contact Senators offices for meetings.
2. Call our Senators in their local office and talk to them on phone.
3. Send fax, letters and emails.
Please keep checking WWW.IMMIGRATIONVOICE.ORG regularly since new materials will be posted frequently. Whenever and wherever you get a chance, please convey your senators that Legal immigration system is broken and needs to be fixed.

My 485 is under processesing with a priority date of March 2006.
I was browsing through the instructions to e-file my I-131 (Travel document) and found this interesting point and was a little confused.
This is from USCIS website
You are not eligible to electronically file this form if:
You have a pending I-485, Application to Register Permanent Residence Status or Adjust Status currently at a USCIS office and you are eligible to file the I-131 for no additional fee.
Does this mean we can no longer file for I-131 online...? I did this last year and didnot have any issue's. Any thoughts/opinions/experiences are highly appreciated. Thanks
