Hi,
I just found this forum and it is really nice place to get some practical information from people gone through all this. I will be applying for Adjustment of Status as I am getting married to a US citizen and I am not. The only thing that I cannot figure out for now is:
Do I have to fill out I-130 and submit it along with the I-485? I am currently on H2B visa in the usa, never been out of status just extended my stay a couple of times. I have my I-94. Also my H2B will expire end of September. Do I have enough time by then to fill out my papers so I do not get out of status. I am getting married by the end of August.

or just go home and enjoy 3 mnths, your H1B will be stamped in the proccess
you application must be amended not to say adustment of status (in the US), the approval can be sent to your local consulate
or go on an O-1 if you can qualify....

I have eb3 -2002 PD . is it possible if my wife applies labor and file 140 with my Priority date . ? Both me and my wife's 485 is pending .

Many of us (including me) are frustrated in waiting for NSC approval of I-140.

NO. Read USCIS FAQ
Hi all,
I am resident of CA and have my I140 application approved from Nebraska. My I485 application was filed in TSC. Is this a issue since according to USCIS, CA residents should file in the NSC. Will my I485 will be rejected because of this issue.

Guys:
just talked to an IO at Nebraska and was told that my file is waiting for an officer to look at.
When I asked how long will it be before they get to it, she says they have like 500 cases each but that I should be hearing something soon?
Any ideas ...how soon ? Has anyone else had a similar conversation and how long did it take before they heard something??
I know there is nothing definate...but just wanting to share and hear back if anyone had similar experience.

Although affected employers and their attorneys will NOT be receiving an additional notice of reinstatement, they may verify their case has been reinstated using the Public Disclosure System (PDS) starting December 1st. Since verification will be available online, employers and attorneys are requested not to contact the Backlog Elimination Centers regarding status.

This Unique Id is good for everyone, T.N.Seshan was recommending this way back in 1988. but the Present Ruling party at that time never agreed because they cannot do hacking polling booths but now it is all very easy.. Guess what.... the EVM electronic voting machines! get rid of that first go back to ballot papers, see who wins and who looses and how people of India are enlightened about the politics. Thanks for maintaining excellent site and answering all sorts of different complex questions.
Now my story.
I am going to apply in next H1B quota and was having below queries:
1. I am confuse about what kind of h1b interview questions will be ask by consulate officer
2. Will they ask my previous work experience letter.. because currently I am in Australia and my work experience was in India and there's no way I can have letter now.
3. How's the job market for Enterprise Oracle DBA
4. And Do I need to keep any extra precautions from start in order to be safe from all future legal problems being a consultant.

Hi all,
I'm on my 5th year of H-1b visa. I had my I-797 approved until 10/30/12. My old passport was due to expire on 2/25/11 so during my recent trip my I-94 was given until 2/25/11, even though my visa is until 10/30/2012. So my lawyer filed I-539 to get a new I-94 on 2/20/11. I still didn't get my case number yet. Now I have another Job offer and the new company's lawyer says that i cannot take another job until this case is complete. I'm totally confused and not sure what to do. Please help. your help is very much appreciated.

Depends on what is written in your LC job requirements. If it is either Masters or BS + 5 yrs of experience, then - yes, you can file I140 in EB2.
Otherwise, you will have to file a new labor.
